These Terms of Service ("Terms") govern your access to and use of crosswalkers.shop and any purchases of Crosswalkers products. By using the site or placing an order, you agree to these Terms. If you do not agree, do not use the site.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By ordering, you represent that you meet this requirement and that the payment method you use is yours.
2. Orders & acceptance
All orders are offers to purchase and are subject to acceptance by us. We may refuse, cancel, or limit any order at our discretion, including for suspected fraud, pricing errors, unavailable stock, or violation of these Terms. If we cancel an order after payment, we will issue a full refund.
3. Pricing & errors
Prices are shown in USD unless otherwise stated and may change without notice. Despite our best efforts, products may occasionally be mispriced or misdescribed. We reserve the right to correct errors and to cancel any order placed based on incorrect information, even after the order is confirmed.
4. Made-to-order products
Most Crosswalkers items are printed and assembled on demand. See our Shipping and Returns policies for production times and the limited cases in which we accept returns or replacements.
5. Intellectual property
All content on the site — including the Crosswalkers name, logo, designs, graphics, photos, text, video, and the cross-snake-egg-staff-horn mark — is owned by or licensed to Crosswalkers and protected by copyright, trademark, and other laws. You may not copy, reproduce, modify, resell, or commercially exploit any content or design without our prior written permission. Personal, non-commercial enjoyment of purchased products is, of course, encouraged.
6. User conduct
You agree not to: (a) use the site for any unlawful purpose; (b) attempt to gain unauthorized access to any portion of the site or its systems; (c) interfere with or disrupt the site, servers, or networks; (d) reverse engineer or scrape the site beyond what is permitted by robots.txt; or (e) use the site to harass, defame, or harm others.
7. User submissions
If you submit reviews, photos, comments, or other content, you grant Crosswalkers a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, and display that content in connection with our business and marketing. You represent that you own or have the rights to the content you submit.
8. Third-party services
Checkout, payments, fulfillment, and certain site features rely on third-party providers (e.g., Shopify, Stripe, Printful). Your use of those services is subject to their own terms. We are not responsible for third-party actions, outages, or policy changes.
9. Disclaimer of warranties
THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CROSSWALKERS, ITS OWNERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM, OR USD $100, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS; IN THOSE PLACES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
11. Indemnification
You agree to defend, indemnify, and hold harmless Crosswalkers and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the site, your violation of these Terms, or your violation of any law or third-party right.
12. Governing law & disputes
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the site will be resolved by binding individual arbitration administered under the rules of a reputable arbitration body, except that either party may bring an individual claim in small claims court. You and Crosswalkers each waive the right to a jury trial and the right to participate in a class action.
13. Termination
We may suspend or terminate your access to the site at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination (IP, disclaimers, limitation of liability, indemnification, governing law) will survive.
14. Changes
We may revise these Terms from time to time. The "Last updated" date will change accordingly. Your continued use of the site after changes are posted constitutes acceptance of the revised Terms.
